OFFICIAL RULES FOR PARTICIPATING & RECEIVING REWARDS
1. PARTICIPATION & REWARD RULES
These participation and reward rules (the “Rules”) set forth the rights and obligations of the participants and the principles how to receive rewards by being part of any community organized by Human8 on any of their platforms. These communities are organized as part of the marketing research activities performed by Human8 on behalf of its clients (“Clients”). Therefore, by participating in the communities and using our platform, the participants warrant to:
- read and accept the Rules;
- undertake to abide by the provisions of these Rules and acknowledge that in case of breach of the Rules, their participation in any Community and or Reward shall be deemed void.
These Rules may be modified at any time by an amendment by Human8 and notified by publishing an updated version of the Rules on the platform under the section rewards policy in the footer. The Rules are a general framework and can be further specified and explained (depending on the community or activity) on the reward card and FAQ.
In the event of any discrepancy or inconsistency between the provision in these Rules and disclosures or other statements contained in any rewards-related materials, including, but not limited to: the entry form, the website, or advertising, these Rules shall prevail, govern and control to the fullest extent permitted by law.
InSites Compages is a limited liability company registered under Belgian Law under number 0837.297.070, with registered seat at Evergemsesteenweg 195, 9032 Wondelgem, hereinafter referred to as “Human8 ”.
Human8 operates and manages the communities (An online insight community is an online platform which connects people to participate in a brand’s research activities. It is supervised by a dedicated moderator and can have a variable duration from short term to ongoing.) on its platform the Square on behalf of its Clients. It can occur that some communities are managed by the Clients itself on Human8 ’ platform. In these communities the participants will be invited to and can engage in several kind of activities, including but not limited to:
- Brainstorm activities;
- Product testing;
- Forum discussion;
(the “Activities” or “Activity”)
Every Activity has its own set of criteria to be eligible to participate. As such not all participants will be qualified for a specific Activity, only the participants who meet the criteria will be invited. This entails that even if you are part of a certain Community, you will not get invited to all of the Activities launched within the Community.
To be eligible to be part of any community participants warrants hereby that:
- they have the legal capacity and agree to comply with these Rules;
- they are not under the age of 18, if not their parent/legal guardian have explicitly accepted these Rules;
- they are not employed by any entity of the Human8 group worldwide;
- they are not related by blood or marriage to an employee of any entity of the Human8 group worldwide;
- they are not part of the household of an employee of any entity of the Human8 group worldwide.
If Human8 suspects, in its own discretion, or is informed by its client that any participant:
- has been involved in any fraudulent or illegal activity (including but not limited to creating several response profiles to participate more than once in an Activity research study, being dishonest about their profile);
- does not act in accordance with the official rules and/or
- is showing ‘bad’ participant behaviour (bad behaviour includes but is not limited to speeding (i.e. when the time spent on completing an activity or survey is 50% shorter than the median, which suggests the questions/ activities have not been answered accurately), straight-lining (i.e. selecting the same response option for a set of questions in a survey) or providing inaccurate or incomplete data (i.e. adding repetitive or monosyllabic answers to most or all questions/ activities, or answering questions or sub-questions partially)), answering with minimum effort and low quality in discussions and community challenges.
(together referred to as “Disqualifying Behaviour”)
Human8 or Client, in their own discretion, reserves the right to disqualify that participant, forfeit the points of a participant, withhold access or recover any incentives or Rewards (in any form whatsoever) and/or unsubscribe the participant from the Activities, community, research study and/or panels. To the maximum extent permitted by law, in no event shall Human8 be liable for any of the losses, damages (direct or indirect) incurred by Participant due to the disqualification or any other actions taken by Human8 as a consequence of the Disqualifying Behaviour of the Participant.
If Human8 or any of its Clients have incurred any damage (direct or indirect) due to Disqualifying Behaviour by participant, participant shall indemnify and hold Human8 and/or Client harmless for the damage incurred.
4. PROCESS TO GAIN POINTS AND SUBSEQUENTLY REWARDS
4.1 Collection of points
A Reward shall be obtained based on the points a participant earns. Points can be exchanged for Rewards. Each Activity has its own Rewards and points. Points can be earned through completing an activity or stream of activities by adhering to a certain standard (meaning quality of the completion/responses) according to the Rules applicable within a certain time frame. The points earned will be automatically added to the participant’s balance under My Rewards Page once the activity closes.
The details of each Activity will be available in the activity and on the activity card. How to earn points will be explained on the reward card and in the FAQ section. This information will minimum include (I) the number of points that can be earned by completing the Activity (ii) the specific timeframe (including start date).
For the avoidance of doubt, participants can earn points by completing Activities under the condition that quality of their responses/completion meets the standards set by Human8 or its Clients. Quality of the responses will be determined by Human8 or the Clients, in their own discretion. A response will be considered as sufficient if that response is following the guidelines provided in the activity in a detailed manner. If a response fails to meet the standards set by Human8 or its Client and as such are not considered as a quality response, Human8 or its Client will have the right to remove, reject the response and no points will be granted.
Points are always whole numbers from 1 upwards. Human8 or its clients always preserves the right to manually intervene on the My Rewards Page and alter the points earned if (including but not limited to) (i) participant have conducted Bad Behaviour (ii) participants are being considered as Inactive (see section below) (iii) Human8 has to intervene to grant the Rewards manually.
4.2 Expiration of points
As long as the participant is active on the Community and takes part in the Activities the participant is invited to, the acquired Points will remain valid. Active entails providing quality responses and completing Activities.
Unless previously and explicitly stated otherwise, participants will be deemed to be inactive if they fail to provide a quality response to minimum 6 consecutive Activities where they were invited to within a time period of 365 days. Only in case the participant has not responded to 6 consecutive invitations of which minimum 1 invite was sent in the first half and minimum 1 invite was sent in the second half of the 365 days, the points will expire. The counter on the My Rewards Page will show an amount of 0 points.
If a participant is inactive the points will expire as from the moment that he/she fails to respond in a timely (meaning the response needs to occur before the activity end date) and quality manner to the 6th invitation.
After a Community has closed, the remaining points that participants have acquired during the term of the Project will be lost. The rewards page will show that the number of points will be 0. In case the Community is reopened the points will no longer be available.
Depending on the amount of points that each participant has earned a Reward can be granted. In some cases this can occur automatically (by reaching a certain threshold or by intervention of Human8 or its Client) or the participant itself can choose to redeem its points for a Reward. In this case, participants can click the redeem button in order to receive their Reward. Your Reward will be granted within a reasonable time period, more information can be found on the reward card or FAQ. You will receive an email and will be asked to provide us with the necessary personal information to grant you the rewards (being full name and address). This personal data confirmation link will be valid for 90 days, afterwards the reward will expire and you won’t be able to redeem it anymore.
Depending on the Community and the reward partner (and their reward availability) the Reward can be redeemed in one of the following options:
- Online payment;
- Charitable donation.
Vouchers are subject to their terms and conditions. Participants are not entitled to a cash equivalent. Vouchers can specify the period within they must be redeemed. Human8 or Client will not be responsible if a voucher is lost, stolen, expired or destroyed and no replacement will be provided in these circumstances. They are not valid on prior purchases. Rewards will not be replaced if lost or stolen. In no event will the value of the redeemed Reward exceed the stated value of the voucher.
Products can be issued by the Client or any third party elected by them. In no event will Human8 be liable for any defects or malfunctions of a product and or damages that should be incurred by a participant as a consequence of these defects or malfunctions.
Human8 or the Client will never be liable for any fees or currency conversion fees linked to any Reward. Participants acknowledge that the type of Reward depends on the reward availability and is linked to the reward partner and the location of that reward partner. Human8 can not be held responsible if a Reward is no longer available.
Participants need to comply with all laws and regulations applicable to receiving these Rewards (including but not limited to income tax regulations).
5. PERSONAL DATA
6. WARRANTIES AND INDEMNIFICATIONS
All participants shall indemnify and hold Human8 and its Clients harmless against any disturbance, action, claim, demand, opposition, liability, loss, damage, cost or expense incurred or suffered by the Client and/or Human8 resulting from any breach of these Rules or use of the platform.
7. DISCLAIMER AND LIMITATION OF LAIBILITY
In no event will Human8 be liable for: (i) any failure of the website during an Activity; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer online systems, servers, access providers, computer equipment or software; (iii) the failure of any entry or other information to be received, captured or recorded for any reason, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in an activity; and/or (v) any combination of the above. Any automated computer receipt (such as a ‘thank you’ message or one confirming delivery of entry) does not constitute proof of actual receipt by Human8 of an activity completion for purposes of these Official Rules.
To the extend permitted by law, Human8 shall not held liable for any issue, compliant, opposition, claim, or damage (i) relate to the use of the responses submitted by the participants (ii) related to any breach of this rules.
8. APPLICABLE LAW AND JURISDICTION
Unless otherwise provided for under applicable laws or regulations of a public policy nature, these rules are subject to Belgian law and any litigation or dispute arising hereunder shall be brought before the court having jurisdiction over such matters in Ghent.
